One of the biggest spammers in the US was sentenced to nine years in prison for violating a Virginia anti-spam law. Jeremy Jaynes claimed, as part of his appeal, that the law itself was unconstitutional, because it violated his right to free speech.
The Virginia court, in a split (4-3) decision, ruled against him, upholding the conviction. Jaynes was charged in Virginia because the e-mails went through an AOL server in Virginia, where AOL is based. Almost all 50 states have anti-spamming laws.

I think, 9 years is too much. But I agree with antispam law because Spam can kill the Internet.
